HOUSTON — A woman claims she slipped on a plastic bag in the parking lot of a Houston gas station and suffered a fractured ankle.
San Juana Hernandez filed a complaint Nov. 3 in Harris County District Court against Ronan Business Inc., doing business as Fuel On Time alleging negligence.
Hernandez was at the defendant’s gas station on Benmar Drive in Houston on April 30, 2021, according to his complaint. She claims after she parked her truck and walked toward the entrance of the premises, she slipped on a plastic bag that was on the ground.
Hernandez further claims her feet slipped out from under her which caused her to lose her balance and fall backward and suffer a fractured ankle and other injuries. She alleges Fuel On Time negligently allowed its premises to become dangerous, failed to keep its parking lot clear of trash and failed to inspect its premises. She also claims the defendant failed to correct or warn of the hazard or take reasonable steps to safeguard its customers.
Hernandez seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Pavel “Paul” Savinov and Sarah Y-Nhi Huynh of The Huynh Law Firm PLLC in Houston.
